Terms of Service
The agreement that governs the Snowbird rent-reporting service.

1. Agreement to These Terms
These Terms of Service ("Terms") form a binding agreement between you ("you" or "Resident") and Snowbird Services LLC, a Utah limited liability company with its principal office at 104 East 600 South, Suite 133, Heber City, UT 84032 ("Snowbird," "we," "us," or "our").
By enrolling in the Snowbird rent-reporting service, clicking "Enroll," checking the consent box on the enrollment page, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not enroll and do not use the Service.
2. The Service
Snowbird is a consumer data furnisher under the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) and Regulation V (12 C.F.R. Part 1022). The Service reports your on-time rental payment history on your behalf to one or more nationwide consumer reporting agencies, including Experian RentBureau and TransUnion (each a "Credit Bureau"), so that your positive rental payments may be reflected on your consumer credit file.
Snowbird obtains your rental payment data from the property manager that owns or manages your rental unit ("Property Manager") and from the property management software the Property Manager uses. Snowbird is not a Credit Bureau, a credit repair organization, a lender, or an agent of any Credit Bureau. Snowbird does not determine your credit score.
3. Eligibility
To enroll, you must:
- Be at least 18 years old (or the age of majority in your state);
- Be a current, leaseholding Resident at a property served by a Property Manager that has contracted with Snowbird;
- Provide accurate personal information;
- Have the legal authority to enter into these Terms.
Minors and non-leaseholders are not eligible. Providing false information may result in immediate termination and exclusion of your data from bureau reporting.
4. Enrollment and Consent
4.1 Opt-In Consent
Enrollment is strictly opt-in. When you enroll, you expressly consent in writing (via electronic record under the E-SIGN Act, 15 U.S.C. § 7001 et seq.) to the following:
- Snowbird may obtain your rental payment history from your Property Manager and its property management software;
- Snowbird may furnish your rental payment information to Experian RentBureau, TransUnion, and other consumer reporting agencies as Snowbird adds bureau relationships;
- Only positive payment information will be furnished. Late payments, missed payments, NSF (returned) payments, partial payments, eviction-related charges, and other negative tradeline events will not be reported.
4.2 Consent Record
When you enroll, we record the exact text of the consent you agreed to, the date and time, your IP address, and your browser's user agent. This record is your audit-grade proof of consent and is retained in accordance with our data retention schedule.
4.3 E-SIGN Disclosure
By enrolling electronically, you consent to receive all notices, disclosures, agreements, and records related to the Service electronically (by email or through our website) rather than on paper. You may request a paper copy at any time by contacting info@snowbird-services.com; reasonable fees may apply. Your consent to electronic records remains in effect until you withdraw it, which you may do by contacting us (withdrawing consent may terminate the Service).
4.4 System Requirements
To receive electronic records, you need a device with internet access, an active email account, and software capable of rendering HTML email and PDF documents.
5. Fees and Billing
5.1 Service Fee
The Service fee is $8.95 per month, added as a line item to your rental ledger by your Property Manager. The first charge appears on the rental ledger for the billing cycle in which you enroll, or the next cycle if enrollment occurs after that cycle's cutoff.
5.2 Billing Mechanism
You do not pay Snowbird directly. The fee is collected by your Property Manager as part of your normal rent payment and remitted to Snowbird under our services agreement with the Property Manager.
5.3 No Pro-Rating
Fees are not pro-rated for partial months. If you cancel mid-month, the fee for the current billing cycle remains due; cancellation becomes effective for the next billing cycle.
5.4 Fee Changes
We may change the Service fee with at least thirty (30) days' advance written notice (by email to the address on file). Continued use of the Service after the effective date of the change constitutes acceptance. You may cancel before the change takes effect without penalty.
6. What We Report (and What We Do Not)
6.1 Positive-Only Reporting
Snowbird furnishes only positive payment information: on-time rent payments, lease start and end dates, property and unit identifiers, and other fields required for accurate bureau tradeline matching. Late, missed, partial, NSF, or eviction-related events are never reported by Snowbird.
6.2 Required Accuracy Fields
To furnish to a Credit Bureau, we must submit fields such as your full legal name, current address, date of birth, lease dates, and payment history. You agree to provide accurate information and to update us promptly if your information changes.
6.3 Reporting Cadence
We report at least monthly for each active tradeline, in accordance with FCRA and bureau requirements.
6.4 No Guarantee of Credit Improvement
We make no guarantee that enrolling will improve your credit score. Credit scores are calculated by credit bureaus and scoring models using many factors, and reporting rental payments is only one input. Individual results vary. Some consumers may see improvement; some may see little or no change; some may see temporary fluctuations. By enrolling, you acknowledge this and waive any claim based on a specific credit outcome.
7. Your Rights
7.1 Right to Cancel
You may cancel the Service at any time by contacting info@snowbird-services.com or by notifying your Property Manager's leasing office. Cancellation takes effect for the next full billing cycle. Upon cancellation, we will stop furnishing new payment data; previously furnished payment data remains on your credit file subject to each Credit Bureau's standard retention practices (Snowbird cannot unilaterally remove accurate, previously furnished data).
7.2 Right to Dispute
You have the right to dispute the accuracy of any information we have furnished about you. You may dispute:
- Directly with Snowbird by writing to info@snowbird-services.com or to the address in Section 16, including your name, address, the specific information you believe is inaccurate, and any supporting documentation; or
- Through a Credit Bureau, which will forward the dispute to us under FCRA § 611.
We will investigate all disputes, correct any inaccuracies we confirm, and report the results in accordance with FCRA § 623. Our detailed dispute procedures are available on request.
7.3 Right to a Copy of Your Consent Record
You may request a copy of your consent record (including consent text version, date, time, and related audit metadata) at any time by contacting info@snowbird-services.com.
7.4 Other FCRA Rights
The FCRA gives you additional rights, including the right to obtain a free copy of your credit report annually from each nationwide bureau. A summary of your FCRA rights is published by the Consumer Financial Protection Bureau at consumerfinance.gov.
8. Your Obligations
You agree to:
- Provide accurate, current, and complete information;
- Promptly update Snowbird or your Property Manager when your information changes;
- Use the Service only for your own account;
- Not enroll another person, impersonate another person, or attempt to gain unauthorized access to the Service;
- Comply with all applicable laws.
9. Third-Party Services
To deliver the Service, we rely on third parties, including:
- Credit Bureaus — Experian RentBureau, TransUnion, and any additional bureaus we contract with;
- Property Manager — the owner or manager of your rental property, who operates the billing relationship with you and the property management software of record;
- Property management software (for example, AppFolio) — used by the Property Manager as the system of record;
- Metro 2 processing software (for example, TSB Software) — used to format and transmit compliant data files;
- Cloud infrastructure and communications providers — for hosting, email delivery, enrollment capture, and audit logging.
These third parties are bound by their own terms and privacy practices, and we are not responsible for their acts or omissions except as required by law.
10. Intellectual Property
All content, trademarks, logos, and software used in the Service are the property of Snowbird or its licensors and are protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works except as expressly permitted. Nothing in these Terms grants you any license other than the limited right to use the Service as intended.
11. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
We do not warrant that the Service will be uninterrupted, error-free, secure against every attack, or that any specific credit-related outcome will result from your enrollment.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SNOWBIRD AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR DAMAGES FROM CHANGES IN YOUR CREDIT SCORE OR CREDIT AVAILABILITY, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU HAVE PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Nothing in this Section limits liability that cannot be limited by law, including liability under the FCRA for a furnisher's failure to comply with § 623.
13. Indemnification
You agree to defend, indemnify, and hold harmless Snowbird and its members, officers, employees, agents, and contractors from and against any third-party claim arising out of or related to (a) your breach of these Terms, (b) your violation of any law, or (c) your submission of false or misleading information.
14. Termination by Snowbird
We may suspend or terminate your enrollment at any time, with or without notice, if:
- You breach these Terms;
- You provide false information;
- Your tenancy ends;
- Your Property Manager terminates its agreement with Snowbird;
- We are required to do so by law or by a Credit Bureau;
- We discontinue the Service in whole or in your market.
Termination does not entitle you to a refund of fees already paid. Previously furnished payment data remains on your credit file subject to each Credit Bureau's retention practices.
15. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will give at least thirty (30) days' advance notice by email to the address on file and by posting the updated Terms at https://snowbird-services.com/terms with a new "Last Updated" date. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree to the changes, cancel the Service before they take effect.
16. Governing Law, Venue, Dispute Resolution
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules, and by applicable U.S. federal law (including the FCRA and Regulation V). The state and federal courts located in Wasatch County, Utah have exclusive jurisdiction and venue for any dispute not subject to mandatory consumer-protection venue rules in your state of residence.
Informal resolution first. Before filing any action, you and Snowbird will attempt in good faith to resolve the dispute by writing to info@snowbird-services.com with a reasonable description of the dispute and desired resolution, and allowing 30 days for informal resolution.
Nothing in this Section prevents either party from seeking injunctive relief to protect intellectual property, confidential information, or to enjoin ongoing unauthorized activity.
17. No Credit Repair Organization
Snowbird is not a credit repair organization under the Credit Repair Organizations Act (15 U.S.C. § 1679 et seq.). We do not claim to remove, dispute, or alter accurate information on your credit report, and we do not charge for "credit repair." The Service is a factual-reporting service only.
18. Miscellaneous
- Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and Snowbird regarding the Service and supersede any prior understandings.
- Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
- No Waiver. Our failure to enforce any provision is not a waiver of future enforcement.
- Assignment. You may not assign these Terms without our written consent. We may assign to an affiliate or a successor in interest.
- Headings. Section headings are for convenience only and do not affect interpretation.
- Force Majeure. Neither party is liable for delays or failures caused by events beyond reasonable control, including natural disasters, labor disputes, governmental action, or outages of third-party services on which we depend.
